“My wife and I are cross-border workers and we are getting married in 2022. What are the consequences for our tax return in France?”
Answer: If you are married or divorced in 2022, the joint taxation policy of spouses or partners will be retained for the rest of the year. However, spouses or partners may choose the year of marriage or the end of the year for separate taxation of their income for that year.
The benefit of the option of separate declaration is not open to the partners bound by the box decided in the previous year, which ends with the marriage of the partners in 2021.
Note that the option of separate declaration is irrevocable, so if it is unfavorable to you, you can no longer go for this option in the context of rectification notice or free claim. So you should study your situation carefully, assess the financial consequences in advance and make your choice!
